Introduction to the Terms of Use Agreement
Our e-commerce store welcomes you and informs you that you will find below the terms and conditions governing your use of this store and all legal implications arising from your use of the store’s services via this electronic platform.
Any use of the store by any person—whether as a consumer of services or products or otherwise—constitutes full acceptance and consent, with full legal capacity recognized under Sharia, regulations, and law, to all the terms and provisions of this agreement, and confirmation of commitment to its contents.
This agreement applies to all forms of transactions between the consumer and the store and shall be deemed effective and binding upon your approval and commencement of registration in the store, in accordance with Article Ten of the Saudi Electronic Transactions Law.
Article One – Introduction and Definitions
The above preamble is an integral part of this agreement. The following terms shall have the meanings set forth below:
- Store: Includes all forms of the store on the internet, whether as a mobile application, website, or physical commercial outlet.
- Consumer: Any person who engages in e-commerce to obtain products or services provided by the store through its electronic platform.
- Agreement: Refers to the terms and conditions of this agreement that govern and regulate the relationship between its parties.
Article Two – Legal Capacity of the Consumer
- The consumer declares that they possess full legal capacity recognized by Sharia and law to deal with the store, or that they are not less than eighteen (18) years of age.
- In the event of a violation of this article, the consumer shall bear full responsibility for any consequences arising therefrom toward third parties.
Article Three – Nature of the Store’s Obligation
- The store’s obligation toward consumers is limited to providing the product or service.
- The store may provide additional services, such as after-sales services or related services, depending on the nature and type of the requested product or service.
Article Four – Terms of Use
- The consumer commits to using the store’s electronic platform in accordance with public morals and the applicable laws and regulations of the Kingdom of Saudi Arabia.
- The consumer commits not to use any purchased product or service in a manner that violates public morals or applicable laws and regulations in the Kingdom of Saudi Arabia.
Article Five – Accounts and Registration Obligations
Upon applying for membership, you agree to provide specific information and choose a username and confidential password. By doing so, you agree to the following:
- You are responsible for maintaining the confidentiality of your account information and password and must immediately notify the store of any unauthorized use or security breach.
- The store shall not be liable under any circumstances for any direct or indirect, material or moral loss resulting from the disclosure of your username or password.
- You are fully responsible for the use of your account. Any use by another person shall be deemed authorization granted by you.
- You agree to use the store seriously and in good faith.
- You agree to provide true, accurate, current, complete, and lawful information and to update it when necessary.
- The store commits to maintaining the confidentiality of your personal data and contact information.
- If the store determines that you have provided false, inaccurate, outdated, incomplete, or unlawful information, it reserves the right to suspend, freeze, or cancel your membership or account without prejudice to its other legal rights.
- Failure to comply with any of the above entitles the store to suspend or cancel your membership or deny access to its services.
Article Six – Electronic Communications and Official Contact Methods
- The parties agree that communication shall be conducted via the registered email address.
- The consumer agrees that all electronic agreements, notices, disclosures, and communications have the same legal effect as written documents.
- The consumer agrees that the store may notify them of any matters related to this agreement via general or targeted electronic messages.
Article Seven – Amendments to the Terms of Use and Fees
- The invalidity of any provision shall not affect the validity of the remaining provisions.
- This agreement, as amended from time to time, constitutes the framework governing the relationship between the consumer and the store.
- The store may impose fees depending on offers, products, services, or government-imposed taxes or fees.
- The store reserves the right to add, increase, reduce, or waive any fees in accordance with this agreement.
Article Eight – Payment and Settlement Services
- The store provides electronic payment options through its partners or other methods it may offer from time to time.
- The store commits to displaying prices in accordance with prevailing market value.
- The store shall provide invoices and receipts for all transactions and deliver purchase invoices to consumers.
- The store shall comply with recognized accounting standards in its electronic store.
Article Nine – Intellectual Property
- All intellectual property rights of the store are fully owned by the store, whether existing before or after establishment.
- The consumer agrees to respect the store’s intellectual property rights, including its name, trademarks, logos, and symbols.
Article Ten – Store Liability
- The store commits to conducting its business in accordance with Saudi laws and regulations and this agreement.
- The store shall not be liable for claims arising from errors or negligence caused directly or indirectly by the consumer or third parties, such as shipping companies.
- The store, its owners, and representatives commit that products or services are lawful, authorized, and used for legitimate purposes.
Article Eleven – Restriction of Access or Membership
The store may suspend or cancel a consumer’s membership or restrict access to services at any time, without prior notice and for any reason.
Article Twelve – Applicable Law
This agreement is governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia and is subject to the jurisdiction of Saudi authorities.
Article Thirteen – General Provisions
- The invalidity of any provision shall not affect the remaining provisions.
- This agreement represents the complete understanding between the store and the consumer.
- The Arabic language shall prevail in the interpretation or translation of this agreement.
- Prices and promotional offers are subject to change and may be modified or discontinued at any time.
- The parties commit to compliance with Sharia principles and applicable laws.
- This agreement may only be terminated by a decision issued by the store’s management.
